TERMS OF BUSINESS

We offer a full advice and recommendation service in all cases. We constantly review the whole mortgage market in order to select the appropriate lender and mortgage product to meet your individual circumstances and needs. We will therefore be acting on your behalf unless you specifically request we act on an instruction only basis. During our initial meeting, we will be completing a detailed mortgage questionnaire to enable appropriate advice to be given to you on your mortgage requirements. We will also provide you with information relevant to your mortgage needs, covering such items as an explanation of the main repayment methods and the implications of taking out a mortgage. Once we have made our recommendations to you, we will confirm our advice in writing. You should keep this as it will be an important record of our discussions. Details of the loan will also be confirmed in your lender’s formal offer.

We charge a fee of 0.35% of amount borrowed subject to a minimum of £350 per property for our Residential Mortgage Services & 0.5% subject to a minimum of £500 for Buy To Let, Equity Release/Lifetime Mortgages. (Commercial Based Mortgages are subject to a 2% Fee subject to a minimum fee of £1000). We only invoice once you have a suitable Mortgage/Loan offer. (As we do not invoice until an offer is issued it is considered our administration time and our expertise has been employed. Refunds will only be considered in exceptional circumstances). We may at our discretion charge a fee for cases of particular depth that require substantial time input. If we do this, such fees will be deducted from your final invoice. Post completion, we may receive fees from lenders with whom we place mortgages. Before you take out a mortgage, we will tell you the amount of the fee in writing. If the fee is less than £250, we will confirm that we will receive up to this amount. If the fee is £250 or more, we will tell you the exact amount.

You will receive a key facts/Esis illustration when considering a particular mortgage.

This will tell you about any fees relating to it. We will treat all your personal information as private and confidential (even when you are no longer a customer) except where permitted by Law or where disclosure is made at your request or with your consent in relation to arranging your mortgage.

You have the right of access under the Data Protection Act 1998 to your personal records held on our files. KMS is registered under the Data Protection Act via The Information Commissioners Office (Z5616507)

Our permitted business is: Advising on regulated Mortgage contracts. Arranging (bringing about) regulated Mortgage contracts or making arrangements with a view to regulated Mortgage contracts. Equity Release & Non-Investment Insurance/Assurance Contracts. (Such as your Life Assurance, Income & Critical Illness Protections &/or your Buildings & Contents Insurance requirements

Our aim is to provide you with a first class professional and confidential service.

We have internal procedures for handling complaints fairly and speedily. Should a complaint arise, in the first instance please contact The Compliance Officer at the address or telephone number detailed above. Thereafter, should the complaint not be resolved to your satisfaction, you may be entitled to refer it to the Financial Ombudsman Service. For your protection KMS is covered by The Financial Services Compensation Scheme. You may be entitled to compensation from the scheme if we cannot meet our obligations. 

These Terms of Business relate to KMS Mortgage Services.

Different Terms of Business may apply to our General Insurance Services.

These will be provided separately where required. 

Your home may be at risk of repossession if you do not keep up repayments on any Mortgage or Loan secured against it.
